District Judge Mark W. Bennett of the Northern District of Iowa sentenced Roque Sablan Norita during the hearing held via video conferencing yesterday.
After the hearing, Bennett, who was in Iowa, remanded Norita to the custody of the U.S. Marshals Service.
Assistant U.S. Attorney James J. Benedetto prosecuted the case while court-appointed attorney Bruce Berline served as Norita’s counsel.
For “ice” possession, the court placed Norita, upon release from prison, on six years supervised release that will run concurrently to his three-year supervised released for the offense of illegal possession of a firearm.
He was required to pay a $100 special assessment fee for each offense, payable after sentencing.
The court waived all fines since it was determined that Norita does not have the ability to pay a fine.
He was required to perform 200 hours of community service under the direction of the Federal Probation Office.
Bennett said he will recommend the Bureau of Prisons to allow Norita to participate in the 500-hour drug treatment program as requested by the defendant’s counsel.
Last April, Norita signed a plea agreement admitting possession of a controlled substance within 1,000 feet of a school, and possession of a firearm by a prohibited person in a separate case.
On Feb. 19, 2009, Norita was caught in possession of “ice.”
Norita traded an Armalite .223 caliber rifle for “ice” sometime in March or April 2009, the plea agreement stated.
Norita also possessed a Colt AR15 .223 rifle, and an Arisaka rifle that was manufactured in Japan in 1940.
