Man gets 40 days for 4th DUI; another gets 50 days for 2nd DUI

SUPERIOR Court Associate Judge Kenneth L. Govendo has sentenced Joem Francis to 40 days in jail for driving under the influence of alcohol and driving without a license. It was Francis’ fourth DUI conviction.

In a separate case, the judge sentenced Roger Abalos to 50 days in jail for his second DUI.

In a June 25 order, Judge Govendo sentenced Francis to 18 months in jail, but all suspended except for the first 40 days. Francis was also given one day credit for time already served. He will serve his sentence in two separate 20-day jail terms. Francis will report to Corrections on Aug. 1 at 8 p.m. and will be released on Aug. 20 at 8 p.m. He will again report to Corrections on Sept. 10 and will be released on Sept. 29.

Francis was also ordered to pay a fine of $1,000. After serving his sentence, he will be placed on three years’ probation. He will also perform 100 hours of community service and pay $385 in probation and court fees.

Judge Govendo likewise ordered Francis to report to the Community Guidance Center after his release from incarceration for an evaluation. He must abide by any recommended course of treatment.

As for Abalos, Judge Govendo gave the defendant three days credit for time already served. Abalos was ordered to report to Corrections on July 6 at 8 a.m. He will be released on Aug. 22 at 8 a.m.

He was ordered to pay a $500 fine and his license will be suspended for 60 days. He will be placed on one-year probation after serving his sentence. He will also perform 60 hours of community work service and pay $145 in court and probation fees.

Other defendants

For his part, Edgar R. Cabaluna was sentenced by Judge Govendo serve 30 days in jail for his second DUI conviction.

Cabaluna was given one day credit for time served and was ordered to report to Corrections on June 30 at 4 p.m. He will be released on July 28 at 4 p.m.

He will pay a fine of $1,000, and his driver’s license will be suspended for six months.

Cabaluna will be placed on two years’ probation after serving his sentence and will perform 80 hours of community work service. In addition, he will pay $265 in probation and court fees. 

Judge Govendo likewise sentenced Kaylan Ann Reyes, As Aisek Jones, Richelle T. Ramon, and Jieyong Zhang for their first DUI conviction.

The four defendants were sentenced to serve a range of three to seven days of incarceration, and each will pay a $500 fine. Each defendant will likewise be placed on one-year probation and perform 40 hours of community work service, except for Jones, who will perform 60 hours.

They were each ordered to pay $145 in court and probation fees.
