Man in driver’s license case appeals 3-month jail term

Court-appointed defense attorney Stephen Woodruff, who represents Hui Qiang Yan, 48, has filed notice of appeal in the U.S. District Court for the NMI.

Yan, also known as Hui Chang, is out on a $25,000 unsecured bond.

Yan will report to the U.S. Marshals Service as soon as a facility has been designated for him.

Yan, a former commercial cleaner, admitted the charge of conspiracy to unlawfully produce and transfer identification document.

During the defendant’s sentencing hearing last November, Chief Judge Ramona V. Manglona noted the seriousness of Hui Qiang Yan’s crime which, she said, put the public in harm’s way.

The U.S. Probation Office recommended two years’ probation, to which Assistant U.S. Attorney Garth Barke agreed.

The sentencing range was from zero to six months.

Woodruff asked the court for one year probation without removal proceedings.
