Associate Judge David A. Wiseman said Minto Minto will spend a year in jail for one count of conspiracy to commit marriage fraud and one year for solicitation, all suspended except for 90 days with both sentences to run concurrently.
But Minto will be placed on probation for five years.
He will also pay a $1,000 fine and $100 for court assessment. He will render 100 hours of community service work and obey all local and federal laws.
He was ordered to report to the Department of Corrections at 8 a.m. on Oct. 22, 2008.
Minto was sentenced without the benefit of a pre-sentence report.
According to the Probation Office, on Aug. 13, 2008, Minto was given a questionnaire to be returned to their office on Aug. 20 but Minto failed to do so.
When the probation office contacted him about it, Minto said he had forgotten about it.
From Aug. 20 to Sept 10, the probation officer tried to contact him several times but Minto’s number was either out of range or turned off.
When he was finally contacted on the afternoon of Sept. 10, Minto told the probation officer that he could not be interviewed for a pre-sentence investigation because he was busy.
The probation officer said Minto hang up his phone and told the officer he was not coming.
The officer said Minto did not cooperate with the pre-sentence investigation.
A six-panel jury found Minto Minto guilty of the two counts filed against him in August.
Minto was charged with three other defendants — Maria Aurelio Ray, Saiful Islam and Munnaf Miah — in A marriage scam case.
The verdict was reached by the jury after a three-day trial.
Minto was represented by his counsel Steven Pixley while Assistant Attorneys General Melissa Simms and Katie Busenkell represented the government.
According to the prosecution, Minto and the other defendants unlawfully agreed to arrange marriages between Islam and Alisilynn Mallens, and between Miah and Severene Kosam for the purpose of obtaining labor and immigration benefits in March 2007.
