Man in unlawful employment case gets suspended sentence

Associate Judge David A. Wiseman at the same time placed Angelito Santos on supervised probation for the remainder of his two years sentence until he voluntarily departs the CNMI.

The defendant entered into a plea agreement and pleaded guilty to one count of unlawful employment of an alien during a hearing on March 4, 2009. The government moved and the court granted dismissal for all other charges in the information.

Santos will pay a fine of $4,000 — $2,000 upon entry of the plea by the bond posted for his release, $1,000 within 45 days of the plea, and $1,000 within 90 days.

He will also pay an assessment fee of $25, a probation fee at an amount to be assessed by the Office of Adult Probation, and restitution to the victim in an amount to be determined by the court.

He will assist in the prosecution of the defendants in cases related to this matter, and will voluntarily depart from the CNMI at his own expense within 120 days of entry of his plea.

He cannot reenter the commonwealth within two years from the date of his departure.

Wiseman set the review hearing for May 6 at 9 a.m.

The Attorney General’s Office charged Santos with seven separate counts of unlawful employment of an alien for hiring workers without complying with labor or immigration requirements.

He was also charged with one count for conspiracy to commit unlawful employment of an alien and three counts of inducement by fraudulent misrepresentation for soliciting $1,500 from three aliens in exchange for assistance in securing employment or benefit.
