Man pleads not guilty to aggravated assault and battery

Superior Court Associate Judge David Wiseman  accepted Hua Feng Sun’s plea and set a status conference for Dec. 16, 2009.

Assistant Public Defender Michael Curtis Brown represented Sun, 37, while Assistant Attorney General Brian Gallagher represented the government.

A $500 cash bail as 5 percent of $10,000 bail has been set for Sun’s temporary liberty while the remaining $9,500 was required to be posted as an under unsecured bond.

Associate Judge Kenneth Govendo ordered Sun’s arrest.

According to the information signed by Assistant Attorney General George Hasselback, Sun was charged with one count of aggravated assault and battery, one count of disturbing the peace, and one count of assault and battery.

According to Detective Jackson Jack’s affidavit, Sun and Xua Huang were playing mahjong behind a night club in western Garapan on Oct. 30, 2009.

After the first game  won by Huang, Sun refused to pay $200 that he owed.

Huang left after an argument with Sun.

Several minutes later, while he was walking toward a poker establishment, Huang felt something hit the back of his head  and he fell him down, police said.

Police said Sun asked for his money from Huang as Sun forced himself on top of the victim, and choked and punched the victim’s face.

Huang was released after treatment from the hospital.

Huang went to the Department of Public Safety, limping, with lacerations to the right side of the head and a bruised forehead,  black eyes and blood-shot eyes, and a bruised body and elbow, police said.

Sun was identified by Huang from the police photos.
