Man sentenced in alien transport case, ordered deported

THE District Court for the NMI has ordered the deportation of Wenxing Wang, despite his possession of a valid U.S. Employment Authorization Document, after he was sentenced for conspiracy to transport an illegal alien.

Chief Judge Ramona V. Manglona sentenced Wang to time served — a total of 57 days — and placed him on probation for one year.

At the sentencing hearing held on Aug. 4, Wang was represented by court-appointed attorney Bruce Berline, while Assistant U.S. Attorney Eric O’Malley appeared on behalf of the federal government.

An expedited presentence report noted that Wang had a valid EAD. O’Malley informed the court that the EAD is valid throughout the United States.

As part of the judgment, Wang was ordered to report to immigration authorities for deportation proceedings.

“You shall not enter the United States of America absent a lawful grant of permission from United States Citizenship and Immigration Services or the United States Department of State. Violation of this term of supervised release shall subject you to revocation of your supervised release and imposition of additional penalties, including a term of imprisonment,” the judgment stated.

Wang was also ordered to perform 40 hours of community service in lieu of a fine, which will be waived upon his removal from the United States.

He was arrested in Guam last June.

Wang was indicted in January 2024 along with co-defendants Lianpeng Zhang, Wenri Piao, Yujian Zheng, and Guizhi Zang for conspiring “to transport and move themselves and each other by boat from the island of Saipan, in the CNMI, to the territory of Guam, knowing that the purpose and intent was to avoid detection by law enforcement and to enter the territory of Guam at a location other than a designated point of entry.”

The indictment states that the defendants paid more than $5,000 “as an overt act toward the completion of the movement and transportation of illegal aliens,” and that they were “citizens of the People’s Republic of China and were in the United States without valid or current legal immigration status.”

Zhang pleaded guilty to the charge on March 8, 2024, and was sentenced to time served in July 2024.

As of Tuesday afternoon, no additional information was available regarding the remaining defendants: Wenri Piao, Yujian Zheng, and Guizhi Zang.
