Man sues store after slipping on wet floor

Foster, represented by attorney Victorino DLG. Torres, named in his complaint Yun’s Corp., doing business as 99 Cents Supermarket.

Torres said his client went to 99 Cents to shop for groceries on May 29, 2009, “when he turned a corner and unexpectedly slipped on a puddle of water that was on the floor.”

He said the slip was so sudden that his client did not have time to react and fell hard on his side and back on the concrete floor.

Foster’s foot “went flying under one of the metal shelves that were being used to stack merchandise,” Torres said.

A 99 Cents staffer tried to assist Foster to remove the victim’s foot from the shelf but doing so caused more pain, the lawyer added.

Torres said his client, at that time, “could not see the water because it was a clear substance that blended into the floor.”

Torres said the store failed to place any warning signs about the slippery floor.

A store staffer told the Variety that none from the management was available for comment.

Torres said his client is asking for compensatory damages, economic and non-economic damages, for medical care and expenses, bodily injury and special damages in an amount to be proven at trial.

The victim is also asking for future damages, for pain and suffering, emotional distress, mental anguish and diminished quality of life in an amount to be proven at trial.

Torres said his client is likewise asking for costs and reasonable attorney’s fees, and other relief.
