Man under removal proceedings arrested for sexual abuse of minors

Castillo has been in the CNMI for over 17 years. He worked here as a carpenter.

Superior Court Judge Perry Inos yesterday found probable cause for the continued detention of Castillo, now jobless.

Inos said Castillo has to answer charges of three counts of sexual abuse of a minor in the second degree, assault and battery, and disturbing the peace.

Assistant Attorney General Peter B. Prestley, who represented the government, asked for a $50,000 cash bail  which the court granted.

Castillo was remanded to the custody of the Department of Corrections after his probable cause hearing yesterday afternoon.

Detective Dennis Masga Reyes was the government witness.

Reyes said authorities are still investigating the case, involving five other children, four to nine years old.

The 14-year-old victim was the one who called for police assistance on Monday night.

Castillo inappropriately touched his victim at his residence, according to the victim.

The victim told authorities Castillo has been sexually molesting her the past three weeks, Reyes said.

Castillo also molested the victim’s younger sister, police said.

Based on interviews by authorities, Castillo would join the children during their play time in the neighborhood’s swing area.

At one point, Castillo inappropriately touched another victim in the swing area, authorities said.

The court appointed Chief Public Defender Adam Hardwicke as counsel for Castillo.

Inos noted that Castillo has an active bench warrant for his deportation in 2009. He quashed the bench warrant. The immigration proceedings in the Superior Court have been dismissed.

“You are a flight risk,” Inos told Castillo after then-CNMI immigration officers did not find the defendant in his address, when authorities checked on him.

Last month, Castillo was among the individuals served with notice to appear for removal proceedings in Saipan immigration court by the U.S. Department of Homeland Security.

In 2009, the CNMI government filed deportation proceedings in Superior Court against Castillo for being an overstayer after his worker’s entry permit expired in May 2006.
