Man who stabbed tofu vendor gets 7 years

Kapileo signed a plea agreement, accepting the charge of aggravated assault and battery by stabbing his victim last April.

The other charges of disturbing the peace, assault and battery, and assault with a dangerous weapon were dismissed by the court upon motion by the prosecution.

Govendo credited the 120 days that Kapileo already served at the Department of Corrections facility.

Upon release from prison, Kapileo will be placed on 10 years probation.

He will pay a $2,000 fine, courts costs and a probation fee.

He will also pay restitution to his victim, Hua Ming Zheng, in an amount to be determined by the Adult Probation Office for any needed medical or psychological examinations or treatment caused by the defendant’s crime.

Kapileo will stay away from his victim and the victim’s family for the duration of his probation, and will write a letter of apology to Zheng.

Assistant Attorney General Shelli Neal prosecuted the case while Chief Public Defender Adam Hardwicke served as Kapileo’s counsel.

Police said Kapileo went to a  store to buy more beer when he met Zheng who was then delivering tofu.

After Zheng refused to give his wallet to Kapileo, the defendant  punched Zheng twice on the head, elbowed him and then pulled out a gray pocket knife from his left pocket and stabbed the victim’s left arm while Zheng was calling for police assistance.

Zheng sustained bruises and a wound on his left arm that required 31 stitches.
