Musician jailed for stalking

Associate Judge David A. Wiseman imposed a $10,000 cash bail for the temporary liberty of Laloulu Henry, a citizen of American Samoa, and a pianist, who regularly plays for a local hotel in Garapan.

Assistant Attorney General George Hasselback, who represented the government in yesterday’s bail hearing, recommended a $5,000 cash bail for the defendant’s temporary freedom but Wiseman doubled the bail, saying the defendant showed disrespect for a protection order from the court.

If the defendant posts bail, he must return to court whenever required to do so, obey all commonwealth laws and surrender his travel documents.  

He must also stay away from all seaports and airports, keep appointments with his attorney and shall have no direct or indirect contact with the victim. He must also comply with all terms on the order of protection issued last month.

Wiseman set the preliminary hearing for Aug. 5 and the arraignment for Aug. 10, 2009.

The defendant was arrested after the Superior Court issued an arrest warrant against him for assault, disturbing the peace, violating an order for protection, stalking in the first degree and stalking in the second degree.

Detective Andrea C. Ozawa stated in her affidavit submitted to the court that at about 11:19 p.m. on July 14, a female complainant reported a contempt of court to the Department of Public Safety.

Ozawa said the same victim called again on July 28 to report another complaint involving the same defendant for contempt of court. Police learned that the defendant violated an Order of Protection issued by Associate Judge Kenneth L. Govendo on June 24 by constantly calling the victim on several occasions.

The Order of Protection stated that the defendant “shall not molest, attack, strike, threaten, sexually assault, batter, telephone or disturb the peace of the petitioner.”

The victim told police that she was with some friends at an establishment in Garapan on July 12 when the defendant came in and startled her by whispering in her ear.

The victim reminded the defendant of the protection order but he called and sent her a text message afterward, telling her that he still love her and he was going to kill himself.

The victim said she ignored the messages but she was very bothered. When she and her companions went to Chalan Kanoa later on, the defendant followed and attempted to get into the same car she was in and shouted at her. The victim

She called the police but the defendant quickly left.

At about 2:36 p.m. on July 28, the victim told police the defendant’s sister sent her a text message telling her to be careful because he was threatening to kill her.
