Associate Judge Kenneth L. Govendo also imposed a two-month jail term on Benedicto T. Lizama, but all suspended except for one day with credit for a day he already served at the Department of Corrections facility.
Lizama was required to pay a $500 fine, a $100 court assessment fee, a $100 probation fee, complete 20 hours of community work service, and obey all federal and CNMI laws.
Lizama signed a plea agreement, admitting the charge of possession of a controlled substance.
In exchange, Chief Prosecutor Michael Ernest moved for the dismissal of the charge of trafficking of a controlled substance.
On Oct. 17, 2010, police saw a marijuana tree, “approximately three inches tall,” above a tin wall adjacent to Lizama’s semi-concrete house in San Roque, “confirming the information received from the concerned citizen.”
Lizama’s residence in San Roque is within 1,000 feet of an elementary school, police said.
The Public Defender’s Office served as Lizama’s counsel.
