Overstaying alien ordered to post $2K cash bail

In Friday’s hearing, Associate Judge David A. Wiseman also ordered 28-year-old Jiang Zhejun to report to the court on Dec. 11 at 2 p.m. for an order to show cause hearing.

The defendant is not allowed to leave Saipan without permission from the court and was ordered to surrender his travel documents.

He will stay away from sea ports and airports, call the Division of Immigration everyday and provide a sketch of his residence as well as names and telephone numbers.

Investigator John Peter of the Division of Immigration, in an affidavit submitted to the court, stated that the defendant was issued a nonresident worker’s entry permit which expired on Aug. 21, 2005.

The defendant was arrested on July 17, 2008 after he admitted working as a taxi driver for a year under the name Minghao Yin.

He presented himself to the Superior Court on Aug. 14 as Minghao Yin when he stipulated to deportation.

Peter said  on Aug. 16, the defendant presented himself to the Asiana ticketing counter at the Saipan International Airport and checked in his luggage as Minghao Yin.

Peter said the defendant told him he needed to talk to a friend first but he did not return.

Prior to the departure of the Asiana plane, Peter said he discovered another male Chinese national who was about to board the airline using the passport and ticket of Minghao Yin. He claimed to be the real Minghao Yin.

Peter said Jiang Zhejun has been eluding Immigration to avoid being deported.  

He said the defendant has no pending labor case and was not issued any temporary work authorization.

 He also does not have any pending employment certification or pending consensual transfer application.

The defendant did not register with the Department of Labor to have further employment opportunity.
