Xi Feng Jiang filed the complaint against Emtaaz Ahmed Chowdhury.
Jiang’s lawyer, William M. Fitzgerald, stated that Jiang was crossing the Chalan Pale Arnold Road by the Gualo Rai building at 1 p.m. on Nov. 19, 2007 within a plainly marked designated pedestrian crosswalk when the defendant stuck her and knocked her to the ground.
Fitzgerald said the defendant was operating his vehicle “at an excessive rate of speed while approaching the crosswalk,” and that he neglected his duty to operate his vehicle with reasonable care and with due regard to others using the road.
The defendant failed to apply his brakes in a timely manner or signal by horn his proximity to the plaintiff, the complaint stated.
He also failed to take evasive action to avoid striking the plaintiff but instead drove directly into the plaintiff, the complaint added.
The defendant failed to yield the right of way and recklessly endangered the lives of other users of the highway, the complaint stated.
As a direct result of the defendant’s carelessness and recklessness, the plaintiff suffered permanent injuries and will continue to suffer pain in the body, mind and emotional distress, and a fracture on her leg which required surgery, the complaint added.
