Repeat offender accused of stealing bush-cutter to plead guilty

Ian M. Dela Cruz was charged with burglary, theft, and resisting arrest. He earlier pleaded not guilty.

The prosecution said Dela Cruz took a bush-cutter of a Kagman resident on Dec. 30, 2010.

In the submitted plea agreement, Dela Cruz will admit the charge of theft, and “recognizing the defendant’s early acceptance of responsibility,” the government will move for the dismissal of the remaining charges with prejudice.

Dela Cruz agreed to be sentenced to one year imprisonment, all suspended except for three months with credit for time served.

It was not known how many days Dela Cruz was detained at the Department of Corrections facility when he was arrested on New Year’s Day.

On July 6, 2005, Dela Cruz pleaded guilty to theft and was sentenced to three years imprisonment, all suspended except for 43 days with credit for time served.

Dela Cruz was placed on three years supervised probation.

He was also asked to write a letter of apology to his victims: DFS Galleria and Joeten Enterprises.

On Oct. 21, 2003, the court sentenced Dela Cruz, who admitted receiving stolen property (a dog), to one year incarceration, all suspended for time already served.

He was placed on one year supervised probation.

Dela Cruz was also asked to write letters of apology to the buyer of the dog, as well as to the actual owner of the  animal.

On Feb. 20, 2003, Dela Cruz pleaded guilty to the charge of unlawful taking in a separate case. Court documents did not mention what Dela Cruz stole in this case.

The court sentenced him to two years  imprisonment, all suspended except for seven days with credit for the seven days he had already served.

He was placed on two years supervised probation.
