Restaurant gets warning from DOLI

A RESTAURANT was ordered to submit complete and accurate information required by the Department of Labor and Immigration or its request to hire foreign workers would be denied.

DOLI recently learned that one of Emperor Enterprises Corp.’s resident workers was not a full-time employee contrary to the declaration submitted to process the renewal application of one of its alien workers, Merlita Castro.

“Appellants are warned that any failure in the future to provide complete and accurate information to the department in connection with the permit process may result in denial of permit applications and may cause sanctions to be assessed against the offending parties,” Hearing Officer Jerry Cody said.

DOLI wanted to establish whether the restaurant was complying with the requirement that at least 20 percent of its workforce must be resident workers.

“The evidence establishes that one of the listed resident workers…is not a full-time employee,” said Cody.

According to labor documents, Castro’s application was denied on Feb. 11 because the company failed to comply with the requirement.

The company filed an appeal.

In his decision, Cody said Emperor had 14 non-resident workers and three full-time resident workers and not four as it previously claimed.

He said this ratio meets the local preference law. Subsequently, he reversed the denial determination on Castro’s application.
