Santos includes 14 court orders in notice of appeal to 9th Circuit

Santos filed his two-page amended notice with his counsel Victorino DLG Torres yesterday, adding 14 court orders to his earlier notice of appeal in the Ninth Circuit which included but is not limited to the Dec. 17, 2008 orders denying his motions of the following: motion to dismiss indictment for failure to state an offense, motion for bill of particulars, motions to dismiss 1998-2000 transactions in Count 1, motion to dismiss indictment for outrageous government conduct, motion to compel discovery, motion to conduct voir dire, motion to use jury questionnaire, and government motion to dismiss defendants’ joinder for untimeliness.

In addition to these eight court orders, Santos included in his amended notice of appeal the Feb. 26, 2009 court order denying co-defendant Timothy P. Villagomez’s second motion for bill of particulars, the March 23, 2009 order denying the motion in limine, the April 6 order denying Villagomez’s motion to dismiss indictment, and the April 16 order denying defendants’ motion to dismiss with prejudice or in the alternative, for a mistrial for alleged jury tampering by the plaintiff.

The other orders Santos included in his amended notice of appeal are the June 9, 2009 order denying defendants’ motion to disqualify U.S. District Court for the NMI Chief Judge Alex R. Munson from handling the case, the July 6 order denying the defendants’ renewed motion for judgment of acquittal notwithstanding the verdict, the July 6 order denying the defendants’ motion for a new trial, and all evidentiary rulings at trial.

Santos, his wife Joaquina Santos and her brother, former Lt. Gov. Timothy P. Villagomez, have appealed their conviction  after their sentencing in federal court on Aug. 5, 2009.

Villagomez was sentenced to seven years and three months, or 87 months imprisonment, while the Santos couple was sentenced to six and a half years, or 78 months imprisonment, each for corruption charges.
