The Senate and the Fitial administration said they were not aware that Itibus, who has been serving the commission for over a decade now, has a pending case.
Court records show that Itibus, 54, was charged with conspiracy with intent to commit the crime of deception.
Special Assistant Attorney General Joseph J. Przyuski filed the case this year against Itibus and Antonio S. Benavente and Edwin Olopai.
According to court documents, the three conspired to take the property of another person by deception.
Press Secretary Charles P. Reyes Jr. said the administration will look into the issue.
“We may have to confer with our lawyers on that matter. We must look at all legal ramifications,” he told the Variety.
“We appreciate this concern being brought to our attention,” he added.
The Senate Committee on Executive Appointments and Governmental Investigations should have verified the information before the confirmation was made, he said.
Sen. Paterno Hocog, R-Rota, who chairs the committee, could not be immediately reached for comments.
Political appointees are only required to submit their resumes, financial statements and drug-test receipts.
Last Aug. 8, Gov. Benigno R. Fitial administered the swearing-in ceremony for Itibus, Frances M. Sablan, Elizabeth DLG. Aldan, Lelanie I. Manglona and Antonio R. Agulto of Saipan as election commissioners.
