Sex offender gets suspended jail sentence for failing to update registration

In a judgment of conviction order signed last week, Associate Judge Kenneth C. Govendo imposed the sentence on Daniel Johnny Jr. and placed him on one year probation under the supervision of the Office of Adult Probation after he admitted noncompliance with the sex offender registry registration requirements.

Govendo set a review hearing for April 9, 2009 at 9 a.m.

The defendant’s counsel was Assistant Public Defender Doug Hartig, while the government was represented by Assistant Attorney General Kevin Lynch.

Govendo told the defendant to keep all appointments with his probation officer and perform 100 hours of community work service, at a minimum of 16 hours per month.

He will also pay a $25 court assessment fee, a $250 fine, and a probation fee that will be determined by the Probation Office.

He will report to the CNMI Division of Immigration to verify his immigration status and show proof to the probation office.

He is ordered to seek full-time employment, and not leave the commonwealth without court permission.

He must have no direct or indirect contact with a minor without the permission of the court, nor must he volunteer or find employment that would allow him to have contact with minors.

Failure to comply with these conditions will be a violation of the probation terms and the defendant may be subjected to further proceedings.

The Department of Public Safety requires all sex offenders in the CNMI to update their registration regularly.

Last year, DPS listed over a hundred sex offenders in its registry.
