Teen gets 30 days for assault

Naraja originally sentenced Marty Keith Concepcion to one year imprisonment, all suspended except for 30 days, with credit for time he already served at the Department of Corrections facility.

Concepcion pleaded guilty to assault and battery, while the assault with a dangerous weapon, and aggravated assault charges were dismissed as part of the plea agreement.

Assistant Attorney General Benjamin Petersburg prosecuted the case while Assistant Public Defender Adam Miles served as Concepcion’s counsel.

Concepcion was arrested on Jan. 6, 2011.

After his release from prison, Concepcion will be placed on two years probation.

Concepcion was required to pay a $100 fine, $25 in court costs, and a probation fee to be determined by the Adult Probation Office.

Concepcion will pay restitution to his victim, Jamal S. Bepary, in an amount to be determined by the Adult Probation Office.

Concepcion will complete 100 hours of community work service, attend and complete anger management counseling and other counseling recommended by the treatment provider, or the Adult Probation Office.

Police said Concepcion greeted Bepary  “Merry Christmas” on Dec. 30, at about 7:33 p.m.

After shaking hands, Concepcion punched his victim on the left side of his face, police said.

Concepcion also threatened to kill Jamal after he kicked his victim on the back side of his body, police said.

It was not explained why Concepcion assaulted his victim.
