Teen gets 7 years for sexual abuse

Govendo originally sentenced Brandon Jay Lisua Borja to 10 years imprisonment, all suspended except for seven years “to be served day for day without possibility of parole.”

Govendo credited the 100 days already served by Borja at the Department of Corrections facility.

The prosecution charged Borja with two counts of sexual assault in the first degree, two counts of sexual abuse of a minor in the second degree, burglary, and disturbing the peace.

It was not mentioned in the court’s judgment and conviction order if Borja will register as a sex offender as mandated by law.

Borja will pay a $2,000 fine, all court costs and probation fees.

He will pay restitution to his victim, who was born in 1996, in an amount to be determined by the Adult Probation Office for any needed medical or psychological examinations or treatments caused by his crime.

Borja will not have contact with his victim and her family during his 10-year probation period.

He will write letters of apology to his victim and her mother.

Borja will not possess or consume alcohol or controlled substances during the period of probation, and he will submit himself to breath, blood, or urine tests anytime the Adult Probation Office so demands.

He will not enter into any place or establishment, or associate with persons that promotes the sale or use of alcohol or controlled substances.

Chief Prosecutor Michael Ernest and Assistant Attorney General Shelli Neal prosecuted the case while Borja was represented by Chief Public Defender Adam Hardwicke.

Detective Peter Aldan said the incident occurred on April 18, 2011, between 4 and 5 a.m., in the house of the victim’s mother in Kagman.

Borja  entered the victim’s room through a window at around 2 a.m., police said.

Detective Aldan said when the victim asked Borja what he was doing there, he told her, “What happened? I’ve been waiting for you.”

Court documents did not establish the relationship between the two.

The victim wanted to shout for help at that time but was scared of Borja who sat on the victim’s bed, Aldan said.

Afterward, she said Borja started sexually assaulting her.

Borja hid inside the victim’s closet when the victim’s mother turned on the light outside her bedroom.

The victim’s mother and responding officers later saw Borja still hiding inside the closet.
