A TEEN-AGER convicted for the fatal beating of a security guard three years ago was sentenced last week over the beating of his girlfriend last year.
Following a plea agreement, Superior Court Presiding Judge Edward Manibusan sentenced 19-year-old Thomas Chargualaf Basa to one-year imprisonment, all suspended except for six months.
Manibusan said Basa will be placed on one-year probation.
The judge said the sentence will run concurrently with Basa’s sentence in the previous criminal case.
The judge ordered the defendant to pay $25 in assessment fee and $40 in probation fee.
Manibusan also required the defendant to write a letter of apology to the victim.
According to court papers, the defendant punched and kicked the victim and also struck her with a buckle at an apartment in Dandan on Sept. 27, 2001.
Police said that the victim was packing her clothes and wanted to move out of Basa’s house.
Basa got upset and hit her with a buckle on the head and back. After punching her on the head several times, he grabbed a plastic cloth hanger and hit her on the arm and leg.
Court papers said the defendant punched the victim again on the head and pulled her hair. He then scratched her neck while slamming her down on the couch.
The victim later told the police that she decided to move out because she was tired of Basa beating her up.
She said Basa accused her of having an affair with his relatives and friends.
Basa was arrested and charged with assault and battery, assault with a dangerous weapon, and criminal contempt.
Basa signed a plea agreement with the government. He pleaded guilty to the assault and battery charge. The government then recommended the dismissal of the remaining charges, which the court granted.
Basa, Eugene B. Repeki Jr. and Anthony Magofna were charged for the fatal beating of a security guard in 1999. The jury acquitted Basa on the charges of second degree murder and voluntary manslaughter, but found him guilty of aggravated assault and battery. He received a three-year jail term.
Repeki was convicted of murder in the second degree and aggravated assault and battery. He was sentenced to 30 years imprisonment.
Magofna was convicted of second degree murder and was subsequently sentenced to 25 years in jail.
