Tinian cop’s ‘ice’ accomplice gets probation

Visiting Federal Court Judge Mark W. Bennett told Carlos Palacios Aldan not to commit another federal, state, or local crime.

Aldan’s court-appointed defense counsel, Bruce Berline, and Assistant U.S. Attorney James J. Benedetto, the prosecutor, earlier recommended six months home confinement for Aldan.

In an e-mail, Berline said: “We are pleased with Judge Bennett’s sentencing. It was fair and reasonable.”

On July 22, 2009, Aldan “knowingly and intentionally” distributed “ice,” according to the plea agreement.

Aldan was the accomplice of Tinian Patrol Officer Gilbert Macaranas who has admitted in “knowingly aiding and abetting” Aldan in distributing “ice” using a Tinian patrol car.

Macaranas is currently out on bail until his sentencing.

Aldan was required to pay a $200 special assessment fee immediately after sentencing, perform 50 hours of community services, submit to drug and alcohol tests as well as collection of a DNA sample.

He must not unlawfully use and/or possess a controlled substance and must participate in substance abuse treatment program.

He is prohibited from possessing a firearm of other dangerous weapon, and must refrain from any use of alcohol. He has to submit to breathalyzer testing.

On May 19, 2010, agents of the U.S. Drug Enforcement Administration and the Tinian police arrested Aldan, Macaranas, and Tinian municipal employee Henry San Nicolas on “ice” charges.

Bennett placed San Nicolas on three years supervised release after the defendant admitted the charge of distribution of a controlled substance.

Bennett sentenced San Nicolas to time served at the Department of Corrections facility.

Variety learned that San Nicolas was incarcerated for 108 days.
