Two women in vehicular accident sue driver

Barbara Ann T. Lontoc and Ana A. Angulo, with the assistance of attorney David G. Banes, filed the complaint against Shane P. Adriano.

The plaintiffs are asking the Superior Court to grant them relief for general and special damages in an amount to be proven at trial, for pre-judgment and post-judgment interest as allowed by law, for costs of suit and for other relief the court deems proper.

The complaint stated that at about 1 p.m. on June 10, 2008, the plaintiffs were traveling along Beach Road in Garapan on a Mazda sedan when the Nissan pick-up truck driven by Adriano hit their vehicle at the back.

According to the complaint, the impact of the collision was so intense that the plaintiffs’ vehicle entered the northbound lane, colliding with an oncoming vehicle.

The plaintiffs’ vehicle spun three times before coming to a rest on the side of the road.

Both plaintiffs were injured and Lontoc lost consciousness.

The two were taken to the Commonwealth Health Center for treatment. The plaintiffs’ vehicle was severely damaged.

The complaint stated that the Department of Public Safety investigation report showed that Adriano was at fault.

The plaintiffs said he, with disregard and reckless indifference to the safety of others, grossly and carelessly operated his vehicle and failed to keep a proper look out for the other users on the road.

The plaintiffs said because of the defendant’s negligence and failure to comply with CNMI traffic rules, they suffered physical injuries requiring the services of medical rehabilitative personnel.

They said they also suffered physical and emotional damages.
