On Thursday, defendant Wei Yuan Ou pleaded guilty to an information that charged him with misbranding of a food product, which carries a maximum penalty of one year imprisonment.
“Pursuant to Fed. R. crim. P48(a), the government hereby moves this court to dismiss the complaint in the above matter…. The government made this motion at that hearing orally, but now files it in writing to complete the record,” U.S. Assistant Attorney Eric O’Malley said in his motion.
Ou will be sentenced on July 15.
According to the affidavit in support of criminal complaint against Ou executed by U.S. FDA Special Agent Garrett Chinn, the defendant sold 29 fake Viagra pills on two separate days in February at SU US Mart in Garapan. Each pill cost $5.
CORRECTION
Ming Li Store, doing business as L&Q Store, said it was not the store that sold the fake Viagra as earlier reported.
Ming Li is owned by the sister of Ou’s wife.
“On Feb. 14, at approximately 1:55 p.m., an undercover agent [or UCA]…entered Ming Li Store, dba L&Q Store, located on Garapan Street…and spoke in Mandarin to a Chinese female, later determined to be Jie Chan Su,” Chinn’s affidavit reads.
“Su identified herself to UCA as having the last name ‘Ou.’ The UCA attempted to purchase erectile dysfunction drugs from Su. According to the UCA, Su stated that she did not have any erectile dysfunction drugs at her store; however, her husband had the drugs at their other store called ‘Chiang Jiang,’ later identified as SU US Mart, located across from the Hyatt Regency Hotel,” he added.
Ou’s plea makes his offense a misdemeanor.
