Victims of sponsorship scheme granted transfer relief

The other two, because they helped promote the scheme, were not granted transfer opportunities.

Labor Hearing Officer Herbert D. Soll identified Elenita E. Camacho of Gem Professional Services as the one who offered employment in exchange for payments even when there was no work provided to the applicants.

Camacho has to pay $5,500 and is permanently disqualified from hiring nonresident workers.

Soll said the nine workers offered “convincing testimony” that they were expecting  salaried positions from Camacho.

The nine are Lina B. Cartegena, Amalia S. Gavino, Carol S. Flores, Winnie N. Mariano, Mary Joy Mirando, Rose P. Ordonez, Blesila B. Prevaldo, Marilou S. delos Reyes, and Ann Janette Sumpay.

The two who were denied transfer of employment were Emma L. Banez and Rowena D. Java.

Soll said Banez worked in the commonwealth for many years and when she was unable to find a transfer employer she conferred with Camacho and was “hired” as an accountant.

In the hearing, Banez admitted she was not an accountant but Camacho still submitted her application.

The entry permit of Banez was issued but no work was ever provided, Soll said, adding that Banez paid Camacho for the renewal of the permit of her non-existing job.

“It is clear that this arrangement was a sponsorship to allow Ms. Banez to have a defacto right to remain in the commonwealth. She was not acting in good faith and is not entitled to transfer to another employer,” Soll said.

In the case of Java, Soll said she has been employed in commonwealth for a decade already but she, too, paid Camacho to submit an application for her employment.

“Java paid Camacho the quarterly withholding tax that was due…. She knew or should have known that such payment was done in furtherance of an illegal arrangement,” Soll said.

He said Java was issued a permit but it was revoked and she was given a temporary work authorization which expired on March 16, 2009.
