Daniel M. Delos Santos, 31, had to withdraw his guilty plea, and will return to court for his jury trial set for Aug. 8, 2011.
It was Wiseman who issued the judgment and commitment order on Aug. 9, 2005 against Delos Santos for assault and battery.
The defendant violated the conditions of his three probationary sentences, the judge said.
According to Wiseman, Delos Santos only served a total of 75 days of the five-year suspended sentences running concurrently, and noted the defendant’s “continuous activity in committing numerous crimes and being convicted of several.”
Assistant Attorney General Russel Lorfing is prosecuting the case, while Assistant Public Defender Adam Miles is serving as Delos Santos’ counsel.
Delos Santos was arrested, together with Ronald Kaipat, for stealing aluminum typhoon shutters early this year, police said.
Details regarding the status of Kaipat’s case were not immediately available.
