After hearing the testimony of Henry C. Sablan as the proposed third party custodian for the 21-year-old defendant, Wiseman expressed his concern on what he described as Sablan’s “career” as third party custodian.
If granted by the court, it would be Sablan’s fourth time to serve as a third party custodian.
Wiseman also required the Public Defender’s Office to identify another property after the court rejected one of the pieces of property — a homestead lot — being offered as appearance bond.
Assistant Attorney General Brian Gallagher represented the government while Assistant Public Defender Richard Miller served as Santos’ counsel during yesterday’s bail modification hearing.
With the cash bail set at $100,000, Santos has been detained at the Department of Corrections facility since his arrest three days after the June 15, 2010 incident.
He was charged with of one count of kidnapping, one count of sexual assault in the first degree, one count of sexual abuse of a minor in the third degree, once count of assault and battery, and one count of disturbing the peace.
Authorities have yet to announce the arrest of the two other suspects in the abduction and rape of a 16-year-old Kagman student two weeks ago.
