Woman gets 30 days for theft

Associate Judge Ramona A. Manglona also placed Estela Dosdos Ngimak on supervised probation for three years and  ordered her to pay court assessment fee of $100 within 30 days.

She will also pay an annual probation fee of $100, which could increase if the defendant fails to comply with the requirements of her probation in a timely manner.

She must write a letter of apology to the victim, Wild Bill’s Bar & Grill, within 30 days and pay a restitution of $250.

She will perform 150 hours of community work service and obey all CNMI and federal laws.

Failure to comply with these conditions will constitute a violation of the terms of the suspended sentence and will subject the defendant to revocation proceedings.

Manglona set the review hearing for May 27 at 1:30 p.m.

If Ngimak does not show up, a bench warrant will be issued against her.

The defendant, represented by Assistant Public Defender Richard Miller, pleaded guilty to theft by unlawful taking or disposition on June 12, 2008 following a plea agreement.

Ngimak was charged with devising a scheme with the receipts of Wild Bill’s Bar & Grill so she could get money to buy prepaid telephone cards which she used to contact her daughter in the Philippines.

Records showed that for several months, the defendant wrote customer’s orders on only one copy of the receipt but did not write on the duplicate receipt for the owner’s copy.

 She was eventually caught after the change funds and sales were found short.

She admitted liability when confronted.

Manglona said it was apparent that the defendant breached her trust with her former employer for a long period of time.  

The court stated that although the defendant has shown remorse and no criminal conduct has been reported since May 2007, 30 days of actual jail time is an adequate punishment for this non-violent offense.
