Almodiel A. Ligaya, with her counsel Eric S. Smith, is asking the court to order Rey R. Canuto and Eusebia Dela Pena to pay her damages in a sum to be determined at trial, the costs of suit and other relief that the court deems proper.
The complaint stated that at 8 p.m. on Sept. 9, 2006, Canuto, who was driving a Toyota Echo, entered the center turning lane at the intersection of Beach Road and Tekken Street.
As he was proceeding to make a left hand turn onto Tekken Street, his vehicle was hit by another car.
Canuto was unable to identify the operator of the car which hit his rear as it fled from the scene immediately.
Canuto’s car proceeded to the north bound lane where his car was struck broadside by a Ford driven by Eusebia dela Pena.
Ligaya, who was a passenger in the Echo, sustained injuries as a direct result of the negligence of the defendants, her complaint stated.
It added that she suffered physical and mental anguish and had to be hospitalized for medical treatment.
She also suffered special and general damages in sums to be determined at trial, her complaint stated.
According to the complaint, Canuto and Dela Pena operated their vehicles at a rate of speed that was dangerous under the circumstances and that they never reduced the speed of their vehicles.
The defendants failed to keep a proper lookout for vehicles driven by others to prevent a collision, and their vehicles lacked the proper brakes and other safety appliances, the complaint stated.
The defendants violated CNMI laws and are guilty of negligence, the complaint added.
