Worker files age discrimination suit vs ex-employer

Carmelito Espina Espinosa stated in his complaint that his termination on May 12, 2009 led to his “loss of livelihood and the depletion of his savings.”

Espinosa claimed that he was terminated due to age discrimination. He was 55 when he was terminated from his employment. He was hired by Saipan Ice & Water in 1988.

Espinosa was the supervisor of its motor pool.

Variety tried but failed to get a comment from  Saipan Ice & Water.

“At the time of his discharge, [Espinosa] was performing his job duties at a level that met his employer’s legitimate expectations,” stated Dimitri Varmazis of the Micronesian Legal Services Corp. which is representing Espinosa.

Varmazis said Espinosa was replaced by an individual substantially younger than his client.

Espinosa earlier filed a claim of age discrimination with the Equal Employment Opportunity Commission, and was issued a notice of right to sue by its Honolulu office.

He is asking the federal court to enter judgment after a determination that his termination constitutes age discrimination.

He is also asking for costs and attorney’s fees.

Espinosa is asking for back pay consisting of wages, salary, and benefits he would have earned but for his unlawful termination, liquidated damages, and reinstatement to his former employment position with Saipan Ice & Water.
