Citing the advice of Assistant Attorney General Kate Fuller, the Zoning Board’s legal counsel, Ogumoro said they need to be more detailed regarding Section 202 of the zoning law which is about applicability, interpretation and construction.
She said the additional amendment will clarify the regulation between the Coastal Resources Management and the Zoning Office.
The Zoning Office believes that Section 202 supersedes CRM regulations regarding building height, setbacks, lot coverage density and parking.
Fuller told the board that the text amendment did not indicate what had been discussed previously by the Zoning Office and CRM.
She said they need to spell out the requirement to avoid overlap, adding that the Zoning Office will deal with parking while CRM will regulate the area within 150 feet from the beach.
