Man gets 60 days for theft, DUI

SUPERIOR Court Associate Judge Joseph N. Camacho has sentenced Johnny John Basiente, 35, to 60 days in prison.

At a change of plea hearing on Oct. 5, Basiente, through Assistant Public Defender Tyler Scott, pled guilty to theft in Criminal Case No. 21-0098D; theft in Criminal Case No. 21-0157C; and Driving While Under the Influence of Alcohol, in Traffic Case No. 21-02222. Mercedes Useneku served as his interpreter while Assistant Attorney General Heather Barcinas appeared for the government.

In Criminal Case No. 21-0098D, Judge Camacho sentenced Basiente to one-year imprisonment, with the first 60 days to be served day by day without the possibility of parole, probation, early release, work release, weekend release, or other similar program. The remaining sentence is suspended but may be imposed in whole or in part for violation of law or Office of Adult Probation rules. 

In Criminal Case No. 21-0157C, Basiente was sentenced to one-year imprisonment, the first 60 days to be served day by day without the possibility of parole, probation, early release, work release, weekend release, or other similar program. Basiente was given credit for one day of time served. His remaining sentence is suspended, but may be imposed in whole or in part for violation of law or Office of Adult Probation rules.

In Traffic Case No. 21-02222, Basiente was sentenced to one-year imprisonment, with the first three days to be served day by day without the possibility of parole, probation, early release, work release, weekend release or other similar program. The remaining sentence is suspended but may be imposed in whole or in part for violation of law or Office of Adult Probation rules.  

Judge Camacho said the sentences in Criminal Case No. 21-0098D, Criminal Case No. 21-0157C, and Traffic Case No. 21-02222 “shall run concurrently.” 

Moreover, Basiente will be placed under supervised probation for a period of three years upon his release from imprisonment and he shall report to the Office of Adult Probation on the next business day after he is released from Corrections. 

The judge also ordered Basiente to pay a fine of $500, court cost of $25 and probation fee in the amount to be assessed by the Office of Adult Probation before the expiration of his probationary period.

He “shall not possess or consume alcohol during his probation period,” and was also ordered to stay away from Guang Zhou Restaurant in Garapan and Fu Bang Restaurant in Chalan Kanoa during his entire probationary period.

Court documents stated that Basiente stole a tip jar at the Garapan restaurant, and cash belonging to the Chalan Kanoa restaurant.

According to the judge, Basiente will perform 80 hours of community work service before the end of this probation. The community work service may be converted to fines. 

He is likewise ordered to pay restitution to Guang Zhou Restaurant in the amount of $70 and pay restitution to Fu Bang Restaurant in the amount of $590 before the end of his probation. 

In addition, Basiente will pay restitution to FSM Recycling in the amount of $500 before the end of his probation.
