Man who assaulted police officer sentenced to time served

MANUEL Santos Aguon has pled guilty to assaulting a police officer and was sentenced to one-year imprisonment, all suspended except for 15 days. He was also given credit for the 56 days he had already served.

Represented by Assistant Public Defender Emily Thomsen, Aguon appeared before Superior Court Presiding Judge Roberto C. Naraja at a change of plea hearing on March 11, 2021 with Assistant Attorney General Steven Kessel representing the government.

Aguon, 67, was sentenced on Wednesday.

He was placed on two years’ probation immediately after release from incarceration, and was also ordered to pay a total of $265 in court and probation fees.

Judge Naraja exonerated any bail posted by the defendant and returned his personal items/passport.

Aguon was initially charged with assault, disturbing the peace, assault and battery, and resisting arrest.

He pled guilty to assault and battery.

According to the factual basis of the plea agreement, on or about Jan. 18, 2021, “Aguon did unlawfully [strike, beat, wound, or otherwise cause] bodily harm” to a police officer….” The defendant kicked the officer in the head and arm, “in violation of 6 CMC § 1202(a), and made punishable by 6 CMC § 1202(b).”

Police stated that they were trying to arrest Aguon who had threatened to kill his wife and her daughter. Aguon resisted arrest and assaulted a police officer who was trying to cuff him.
