In Civil Action No. 10-040, Ngirmang brought a lawsuit against MSPLA members, Secharuleong Theodore Rengulbai, Orukei Miawo Kadoi, Lazarus Kodep, Rechebong Sbal , Ngetibuchel Uchel Mekreos and Caleb Rechelbang for executing a lease agreement with Hiroshi Okagawa.
Okagawa’s lease agreement provides a term of 99 years.
According to the suit, the lease agreement which was signed in August 2008, was not signed by Ngirmang who is also the chairman of MSPLA.
The civil action suit added that it was only in January of this year that the plaintiff learned of the lease agreement and immediately warned the defendants that the lease is void.
Ngirmang said he sent follow-up letters but the defendants remained unresponsive to the letters.
The agreement was void because it was not discussed in meeting nor was there a recording of the meeting.
The agreement was also not ratified as required by law thus it does not have its full force and effect.
Ngirmang is seeking for punitive damages of $10,000 from the defendants.
