HAGÅTÑA (The Guam Daily Post) — Gershman, Brickner & Bratton Inc., the federal receiver overseeing the former Ordot dump facility, is waiting on some documentation from the Guam Waterworks Authority to determine how it will move forward with its claim regarding the impact water leaks have had on the dump’s leachate collection system.
GWA earlier rejected a $2.6 million claim from the receiver.
“Following that, there were numerous dye test observations,” Joyce Tang, GBB’s legal counsel, said Thursday during a Guam Solid Waste Authority board meeting.
“My understanding is they’re inconclusive at this point and I think we’re waiting for some fluorometers and potentially additional dye test. I suppose we’ll get more information on the dye test in the near future,” Tang said.
A leachate and seeps investigation is ongoing in connection with the claim, with a technical report in progress, according to Tang.
GBB sent a Sunshine Act request to GWA on March 20. The water utility asked for an extension of time to respond, and they now have until April 19 to provide requested documents.
“Depending on the results, we’ll review the results and I’m sure the information will be discussed in our biweekly meet and confer and the receiver will then consider further actions following that information provided by GWA,” Tang said.
GBB requested various items from GWA related to the water leak, how long the utility knew about the leak, any report or investigation about the leak and any other information relevant to supporting the claim regarding the leak, according to Tang.
“Hopefully, the information that is provided would be helpful in reaching some kind of settlement with GWA,” Tang said.
