FRITZ Pacific Project Development Services, through its principal, Alfredo Cabael, has reached an agreement with Imperial Pacific International LLC.
Fritz Pacific sued IPI for breach of manpower staffing subcontract.
IPI, through attorney Stephen Nutting, recently filed a stipulation for an entry of judgment in favor of Fritz Pacific in the total amount of $525,466.70.
According to the stipulation, which was also signed by Fritz Pacific, IPI shall pay Alfredo Cabael in the amount of $70,000 within 30 days of the entry of judgment.
The remaining balance of $455,466.70 shall be paid in 24 equal monthly installments of $18,997.78 with the first installment to start on Sept. 30, 2021.
The federal court retains jurisdiction of the case for the purpose of enforcing the judgment.
On July 26, Chief Judge Ramona V. Manglona of the District Court for the NMI instructed the clerk of court to enter judgment pursuant to the stipulation.
Judge Manglona also directed the parties to bear their own attorney’s fees and costs.
Magistrate Judge Heather Kennedy issued a judgement in favor of Cabael on Aug. 2.
IPI hired Fritz Pacific to provide manpower staffing services for the hotel-casino construction project in Garapan.
IPI and Fritz Pacific entered into two successive contracts beginning around June or August 2018.
As part of the agreement, Fritz Pacific was to provide IPI with skilled plumbers, carpenters, masons, electricians, welders, skilled helpers, tower crane operators, heavy equipment mechanics, mechanic helpers, electronic equipment technicians, tractor trailer operators, boom truck operators, riggers, and two laborers.
According to Fritz Pacific, IPI only made partial payments on the billings and invoices.
