SUPERIOR Court Judge Joseph N. Camacho has found probable cause to charge Omar Nawaz with indecent exposure.
Nawaz, 35, who is believed to be homeless, is accused of pulling down his pants and exposing himself to a 6-year-old girl at a restaurant in Garapan last November.
At a preliminary hearing on Wednesday, Nawaz appeared in the custody of the Department of Corrections and was represented by Assistant Public Defender Karie Comstock. Assistant Attorney General Daniel Johnson appeared for the government.
After hearing testimonies from Police Officer Freddie Guerrero and Detective Steven Aldan, Judge Camacho found probable cause to charge Nawaz with indecent exposure in the first and second degree, and with two counts of disturbing the peace.
Nawaz’s arraignment is set for July 14 at 9 a.m. before Presiding Judge Roberto C. Naraja.
According to the complaint, the girl’s mother told police that she had gone to the restaurant with her 6-year-old daughter and 8-year-old son. The restaurant had glass windows.
She said they chose a table beside a glass window, with her children seated facing north while she sat facing south.
The mother said she observed a man — later identified by police as Nawaz — walking back and forth in front of the window where they were seated.
She said her daughter then asked to sit somewhere else and appeared sad after gazing out the window. When the mother looked in the direction her daughter had been staring, she saw Nawaz with his pants down, exposing himself and smiling.
The mother said she yelled at Nawaz and asked the restaurant staff to call the police. Nawaz then ran south. Police later located him on Paseo De Marianas Road and placed him under arrest.
According to Variety news files, police previously arrested Nawaz in December 2020 for assaulting a gasoline station employee.
