Associate Judge David A. Wiseman was supposed to preside over a jury trial for Borja, 50, on Monday.
Assistant Attorney General Russel Lorfing is prosecuting the case while Janet King is the defense counsel.
Borja was charged with three counts of assault and battery, one count of child abuse, and three counts of disturbing the peace.
On Jan. 8, 2010, Borja punched three times his son Joseph on the head, and slapped his son’s common-law wife after learning that they failed to attend a rosary prayer, police said.
While Borja was punching his son Joseph, the six-month-old baby that Joseph was holding was also hit in the head — the child’s forehead also hit the back rest of the chair, police said.
Borja, who earlier denied the charges, is currently out on bail.
