The Adult Probation Office told Superior Court Associate Judge Kenneth L. Govendo that Kevin Mendoza Piol tested positive for marijuana use on Jan. 14, 2010.
Piol also failed to appear at the Community Guidance Center for his counseling evaluation.
He still has to perform 12 hours of his court ordered 70-hour community work service.
Piol was initially employed at a car rental company “but only for a short period of time.”
He has been unemployed and “has not been submitting any applications to prove that he is actively job seeking,” the Adult Probation Office said.
Piol has yet to pay for his fines and has failed to report to the Adult Probation Office on a monthly basis since Feb. 2009.
Piol was convicted of theft.
On Oct. 23, 2008 he was placed on probation by the Superior Court for a period of five years that will expire on Oct. 23, 2013.
Details of Piol’s sentencing were not available.
Assistant Attorney General Shelli Neal is prosecuting the case while Chief Public Defender Adam Hardwicke is representing Piol.
