Man in misuse of passport to undergo removal proceedings

Designated Judge David A. Wiseman yesterday sentenced De Zhu Sun, 32, after the defendant pleaded guilty.

The defendant’s court-appointed attorney, Colin Thompson, and Assistant U.S. Attorney Kirk Schuler, the prosecutor, agreed that the submission of a presentence investigation report be waived.

Schuler earlier recommended a sentence equivalent to Sun’s time served with one-year supervised release. Colin concurred and the judge approved it.

If removal proceedings fail, Sun will immediately start his supervised release the judge said.

All fines were waived but Sun was required to pay a $10 special assessment fee.

Federal Bureau of Investigation special agent Haejun Park arrested Sun on July 21 while the defendant was attempting to leave the island after presenting a Chinese passport that belonged to another person. Sun was about to board a plane to China.

The Superior Court, for its part, has continued the sentencing hearing for Sun who was convicted by a jury for receiving stolen property — 100 boxes of Polo shirts from the L&T garment factory warehouse in Lower Base.

At the time of this arrest, Sun was supposed to be sentenced in Superior Court.
