Superior Court Associate Judge Perry Inos imposed a $25,000 bail each on Joseph Ray Arriola Jr., 20, and Kurt M. King, 29, and remanded them to the custody of the Department of Corrections after their initial hearing yesterday afternoon.
Tinian Detective Melvin L. Monkeya filed a declaration of probable cause in support of the issuance of an arrest and search warrant.
Arriola and King were charged with sexual assault in the first degree.
In his affidavit, Monkeya said the victim told the Department of Public Safety that Arriola and King sexually abused her against her will at a cemetery in Tinian on Saturday morning.
The victim said they were celebrating her sister’s birthday at their house on the night of Friday, when Arriola and King came in uninvited, and had a drink with them.
The sisters and another girlfriend then went to a night club to continue the birthday celebration.
The victim later went out for a ride to go home on her girlfriend’s car, parked near a laundry area, where the victim vomited.
She said Arriola and King suddenly approached their car.
King, the victim said, opened the car’s door and tried to get her out.
King told her that he would drive her home, the victim said.
She told police she declined and told King that she was already drunk.
Arriola and King, the victim said, still took her out of her friend’s car and brought her to the front passenger seat of King’s car.
The victim said King drove the car toward the cemetery, where King and Arriola took turns in sexually abusing her.
The victim passed out.
The sister who came back after lighting cigarette at the laundry area, asked their friend where her sister was, and the friend pointed to Arriola and King who took her sister.
Arriola is represented by Chief Public Defender Adam Hardwicke, while Ramon Quichocho is King’s counsel.
Assistant Attorneys General George Hasselback and Kathleen Busenkell are prosecuting the case.
