‘Top Gun’ cop gets 3 years, 6 months

During the change of plea hearing yesterday, Superior Court Associate Judge David A. Wiseman credited time already served by Pangelinan, 21, at the Department of Corrections after he was arrested in February.

Pangelinan pleaded guilty to assault with a dangerous weapon.

“[Pangelinan] shall at least serve two years before he is eligible for parole,” Wiseman said in his written judgment and commitment order yesterday.

The government represented by Assistant Attorney General Brian Gallagher moved for the dismissal of the remaining charges as part of the plea agreement.

Pangelinan, represented by attorney Loren Sutton, was originally charged with assault with a dangerous weapon, violating an order of protection, sexual assault in the first degree, assault and battery, criminal mischief, kidnapping, and three counts of illegal possession of ammunition.

Pangelinan was with the 19th Police Academy when he received the “Top Gun” award for marksmanship in Dec. 2008.

Over a year later, Pangelinan was arrested for a domestic violence incident during which he fired shots above the head and near the victim’s ear, the prosecution said.

Pangelinan had another domestic violence case in Aug. 2009, when another woman sought a protective order against him.

Wiseman, in his order, required Pangelinan to be on supervised release for the remainder of his suspended sentence under the direction and supervision of the Adult Probation Office after his release from jail.

Pangelinan was also required to perform 200 hours of community work service.

He will pay a $200 fine, a $150 assessment fee and a probation fee to be determined by the Adult Probation Office.
