Man gets 2-month jail term for failure to undergo drug testing

Chief Judge William H. Alsup of the Northern District of California revoked Juan Teigita’s supervised release upon petition by the Federal Probation Office.

On Nov. 21, 2000, Teigita was sentenced in the U.S. District Court for the NMI to a term of 96 months and three years of supervised release for  interference with commerce by robbery, and use of a firearm in relation to a crime of violence.

The Federal Probation Office said Teigita failed to participate in a substance abuse treatment program which includes testing for substance abuse as special condition of his supervised release.

Alsup directed Teigita to turn himself in to the U.S. Marshal Service before noon tomorrow.

Assistant U.S. Attorney Eric O’Malley represented the federal government while Teigita’s counsel was Bruce Berline.

Teigita admitted to the violation.

The prosecution recommended a six-month jail term with 29 months supervised release.

But the defense felt the recommendation was too severe, saying it would cause Teigita to lose his employment.
