Man gets 589-day jail sentence for knife assault

Superior Court Associate Judge Perry B. Inos sentenced He  Jiao to eight years imprisonment, all suspended, except for two years, with credit for time already served. There will be no possibility of parole.

He Jiao is expected to be released on Dec. 24, 2010.

He Jiao pleaded guilty to assault with a dangerous weapon.

Other charges filed by the Attorney General’s Office against He Jiao were one count of assault and battery, one count of aggravated assault and battery, one count of attempted second degree murder.

Chief Public Defender Adam Hardwicke was He Jiao’s counsel while Assistant Attorney General Michael Evangelista represented the government.

A translator assisted He Jiao during his trial.

Using a large kitchen knife, He Jiao cut the upper back and the back of the head of Jifei Zheng on Aug. 17, 2009, according to the AGO.

Inos placed He Jiao on probation for the remainder of his suspended sentence.

He Jiao will write a letter of apology to his victim and pay a fine of $50 and $25 in court assessment fee.

He will perform 100 hours of community work service and must abide with the recommended counseling at the Community Guidance Center.

The Victim Advocate’s Office will determine  restitution for his victim within 90 days.

He Jiao was ordered not to have any contact with his victim, and to obey CNMI and federal laws.
