Court dismisses marriage fraud case

In his written order on May 14,, Superior Court Associate Judge David Wiseman dismissed the case against Amzad Hossain “based on the representation of both counsels and for good cause.”

No other details were provided by the court.

Assistant Attorney General Brian Gallagher represented the government while attorney Brian Sers Nicholas was Hossain’s counsel.

Hossain was charged with one count of conspiracy to commit marriage fraud, and one count of conspiracy to commit document fraud.

Hossain’s co-defendant Delora Taman Bhuiyan, 30, also known as Delora Taman Gang, pleaded guilty to marriage fraud and document fraud.

She was also charged with  conspiracy to commit marriage fraud, conspiracy to commit document fraud, bigamy, and perjury.

Another defendant Zheng Gang, husband of Delora Taman Bhuiyan, fled the CNMI in April 2009.

Delora Taman Bhuiyan, a U.S. citizen, married nonresidents so they could obtain immediate relative status, according to the prosecution.

Delora Taman and Mohammed Shoukat Bhuiyan were married by Wiseman on March 28, 2007.

On Feb. 10, 2010, Wiseman sentenced her to three years imprisonment all suspended except for one day with credit for one day already served after she pleaded guilty to marriage fraud.

She has to write a 45-word letter of apology to the public, perform 100 hours of community work service, and pay a $1,000 fine which may be converted to community work service.

She will also pay a $100 assessment fee.
