Plaintiffs Alan Marbou, Darvin Inabo, Lamp Olkeriil Minor, Cleoffas Iyar, Jasen Lee Pedro, Rdialul Rumong and former employee Misia Orrukem.
The plaintiffs in their civil action suit said that they were covered by the policies and procedures manual for Koror State government which stated that each employees should be treated with fairness and impartiality and that each of them has the right to vote for the candidates of their choice and express their opinion as individuals.
The plaintiffs said the demotion or termination is clearly a violation of the manual.
The employees and former employee are seeking compensatory and punitive damages and asked the court to issue an order reinstating plaintiffs to the position held prior to thrie demotions/ terminations and with awards of back pays and all lost fringe and pension benefits.
The plaintiffs are also seeking an order enjoining any further acts of retaliation and illegal employment practices on the part of the defendants.
In an interview, Adachi said he will let the court decide on the matter.
On Monday Adachi received his summons concerning the complaint of the six employees and a former employee.
“Filing a lawsuit is their fundamental right. I have a choice and it’s their choice. I have no grievance against those people who filed a lawsuit, so I let the judicial system take its course.” Adachi said in an interview.
He said that he re-assigned the six employees due to the budget constraints. He also added that before he made the action he made a careful review of the personnel manual.
“If they think that unfair treatment has been done to them, then that is their prerogative.” Adachi added.
He said that the Koror State lawyer will handle the issue.
Earlier, Adachi re-assigned the six employees because of allegedly failing to support him during the November 2009 General Election.
The governor however denied the allegation. He said the re-assignment was based on their duties and responsibilities.
