Degala was also to be released to Teresita Sumpay as his third party custodian.
Degala has been charged with assault with a dangerous weapon, assault and battery, disturbing the peace.
Judge Perry B. Inos granted the motion to modify bail which was filed by the Public Defender’s Office.
Inos ordered Degala to stay away from his girlfriend, the victim in this case, and to obey the terms and conditions of his pretrial release imposed by the court.
It was not known if Degala was able to post bail after his hearing last Friday morning.
Degala is being represented by Assistant Public Defender Douglas Hartig.
Assistant Attorney General Tiberius Mocanu represented the government during the hearing.
The AG’s Office charged Degala with assaulting his girlfriend with a knife on Aug. 24, 2011.
Assistant Attorney General Nicole Driscoll told the court the current bond amount “is fair given the alleged facts.” Moreover, the defendant “should not be released to a third party custodian [as he] presents a continuing danger to the community.”
Driscoll said Degala “has demonstrated a significant disregard for the laws of the commonwealth and for the safety of the victim.”
Degala “has shown that he is a violent man who is unable to control his anger,” Driscoll said.
On Aug. 23, at about 9 p.m., the victim returned home to find Degala, her boyfriend, drunk.
The victim left the house again to go to the neighbors, and returned home at around 1 a.m., Aug. 24.
Degala was angry and they began to argue.
After telling Degala that she no longer loved him and that she was involved with another woman, Degala took the victim’s mobile phone and broke it.
Degala the threatened to kill his victim with a knife, the AGO said.
It added that Degala then forced his victim to have sex with him.
The victim was too frightened to call the police that night, but called the Department of Public Safety at 11:46 a.m. the following morning.
