Final arguments in burglary, theft case

Yesterday afternoon, the defense rested its case after attorney Douglas Cushnie, who is representing defendant Ronald Kaipat, presented three witnesses, including inmate Daniel M. Delos Santos, a co-defendant in this case who was already sentenced.

Kaipat is currently out on bail.

Last July, Wiseman sentenced Delos Santos to five years imprisonment, all suspended except for 18 months without parole, with credit for eight days served at the Department of Corrections facility. Delos Santos stole typhoon shutters at the San Jose Mobil service station last January.

In his testimony, Delos Santos said Kaipat was not involved in the burglary and theft. He added he was with another individual, by the name of Alfred whose last name he couldn’t recall.

The prosecution presented a staffer from the Mobile service station who witnessed Kaipat’s involvement.

Assistant Attorneys General Tiberius Mocanu and Nicole Driscoll are prosecuting the case.

Detective Buddy Igitol was the case agent.

On Jan. 23, 2011, Delos Santos and Kaipat were arrested by authorities for stealing 30 pieces of aluminum typhoon shutters.

It was Wiseman who issued the judgment and commitment order on Aug. 9, 2005 against Delos Santos for assault and battery.
