Court asked to reschedule sentencing of DYS jail guard

Joseph James Norita Camacho, Fitial’s attorney, further told the court that the prosecution did not object to his request to move the sentencing from Sept. 13, 2011 to a date on or after Oct. 11, 2011.

Camacho said the deadline for his client to submit any comments, corrections or objections to the submitted presentence investigation report was today.

Camacho said his client had several concerns about the presentence investigation report, and “counsel needs additional time to research the legal issues and prepare appropriate objections to the presentence investigation report” submitted by the U.S. Probation Office.

Camacho said he recently handled a jury trial for another client two weeks ago in federal court.

He has two upcoming trials in the CNMI Superior Court.

Fitial has pleaded guilty in federal court to enticement of a minor.

The 26-year-old is facing a minimum of 10 years in federal prison for that offense.

Fitial has been in detention since June 11, 2010 after the Federal Bureau of Investigation arrested him.

The federal court set no bail for Fitial.

He was also charged in Superior Court for sexual abuse of a minor in the second degree, two counts of exploitation of a minor, assault and battery, misconduct in office, failure to report child abuse or neglect, and sexual servitude of a minor.

The case has yet to be adjudicated.
